1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you ("Customer", "you", or "your"), whether personally or on behalf of an entity, and Vinsdaddy ("Company", "we", "us", or "our"), concerning your access to and use of vinsdaddy.com and any related media, channels, or mobile applications (collectively, the "Site"). By accessing the Site, you confirm that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree, please do not use the Site.

2. Payment Processing & Authorized Reseller

Vinsdaddy uses third-party payment platforms to process all transactions. Depending on your region and the product purchased, your payment may be processed by one of the following authorized resellers acting as the Merchant of Record:

FastSpring

Transactions processed by FastSpring, Inc. ("FastSpring") are conducted under FastSpring's terms of service. FastSpring is an authorized reseller of Vinsdaddy products and acts as the Merchant of Record for applicable transactions. Your card or bank statement may reflect a charge from "FSPRG" or "FastSpring" rather than "Vinsdaddy". FastSpring's terms and privacy policy govern the payment transaction itself. Lemon Squeezy

Transactions processed by Lemon Squeezy LLC ("Lemon Squeezy") are conducted under Lemon Squeezy's terms of service. Lemon Squeezy is an authorized reseller and Merchant of Record for applicable transactions. Your card or bank statement may reflect a charge from "Lemon Squeezy" or "LS" rather than "Vinsdaddy". For billing inquiries related to Lemon Squeezy-processed orders, contact: support@vinsdaddy.com.

Vinsdaddy is not responsible for the payment processing terms, policies, or practices of FastSpring or Lemon Squeezy. By completing a purchase, you also agree to the applicable terms of the payment processor used for your transaction.

3. Products & Digital Goods

Vinsdaddy provides digital vehicle history reports and related data services ("Reports"). All Reports are digital goods delivered electronically. Upon successful payment, you will receive access to your Report as described at the time of purchase.

You acknowledge that:

Reports are generated using third-party public records databases and may not reflect all historical events for a given vehicle.
We do not guarantee 100% accuracy, completeness, or timeliness of data obtained from public records sources, including but not limited to DMV records, NMVTIS, insurance databases, and salvage records.
Report data is provided for informational purposes only and should not be the sole basis for any purchasing or financial decision.

4. Refund Policy

Vehicle history reports are digital goods. Once a Report has been generated and delivered, the sale is considered final. Refunds will only be issued in the following circumstances:

We were entirely unable to generate a Report or retrieve any data for the VIN you provided.
A duplicate charge occurred due to a technical error on our platform.

Refunds are not issued on the basis of data accuracy, partial data availability, or dissatisfaction with the content of a Report. Please verify your VIN carefully before completing a purchase.

For subscription plans (where applicable), you may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period, and no refunds are issued for the unused portion of an active billing period. Subscriptions must be cancelled at least 24 hours before the next renewal date to avoid being charged for the next period.

To request a refund or report a billing issue, contact us at support@vinsdaddy.com within 7 days of your purchase.

5. Subscriptions & Auto-Renewal

Where Vinsdaddy offers subscription-based access, the following terms apply:

Subscriptions automatically renew at the end of each billing period (monthly or annual, as selected) unless cancelled before the renewal date.
You authorize us and our payment processor to charge the payment method on file at the start of each renewal period.
We reserve the right to change subscription pricing. You will be notified of any pricing changes at least 30 days before they take effect. Continued use of the service after a price change constitutes acceptance of the new price.
To cancel a subscription, log into your account or contact support@vinsdaddy.com. Cancellations must be received at least 24 hours before the next billing date.

6. Intellectual Property Rights

Unless otherwise indicated, the Site and all its content — including source code, databases, software, designs, text, graphics, logos, and trademarks (collectively, the "Content") — are the proprietary property of Vinsdaddy or its licensors and are protected under applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access the Site and view Reports for your personal, non-commercial use only. You may not:

Reproduce, distribute, sell, or sublicense any Report or Content.
Scrape, crawl, or use automated tools to extract data from the Site.
Use Report data for resale, commercial redistribution, or incorporation into any competing product or service.
Remove or alter any copyright, trademark, or proprietary notices from the Content.

7. User Representations

By using the Site, you represent and warrant that:

All registration information you submit is truthful, accurate, current, and complete.
You will promptly update your account information to keep it accurate and current.
You have the legal capacity to enter into these Terms and agree to comply with them.
You are at least 18 years of age or the age of majority in your jurisdiction.
You will not use the Site for any illegal, fraudulent, or unauthorized purpose.
Your use of the Site will not violate any applicable local, national, or international law or regulation.

8. Prohibited Activities

You agree not to engage in any of the following activities:

Using the Site to stalk, harass, or harm any individual.
Attempting to circumvent, disable, or interfere with security features of the Site.
Uploading or transmitting viruses or any other malicious code.
Using the Site in any manner that could disable, damage, or impair it.
Using data obtained from Reports for discriminatory purposes or in violation of the Fair Credit Reporting Act (FCRA) or similar laws.
Reselling or redistributing Report data to third parties without prior written consent from Vinsdaddy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Vinsdaddy, its directors, employees, agents, or affiliates be liable to you or any third party for any direct, indirect, incidental, consequential, exemplary, special, or punitive damages — including lost profits, lost revenue, loss of data, or other damages — arising from your use of the Site or Reports, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claims arising out of or related to these Terms or the Site shall not exceed the greater of: (a) the amount you paid to Vinsdaddy in the 30 days prior to the claim, or (b) USD $10.00.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

10. Disclaimer of Warranties

The Site and all Reports are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied. Vinsdaddy expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that: (a) the Site will be uninterrupted or error-free; (b) defects will be corrected; (c) the Site or its servers are free of viruses; or (d) Reports will be complete, accurate, or up to date.

11. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, available at vinsdaddy.com/privacy-policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

We comply with applicable data protection laws, including the California Consumer Privacy Act (CCPA) and, where applicable, the General Data Protection Regulation (GDPR). If you have questions about your data rights, contact us at support@vinsdaddy.com.

12. Third-Party Data & Accuracy Disclaimer

Reports generated by Vinsdaddy are compiled from third-party public record sources, which may include government databases, insurance records, NMVTIS, salvage records, and other data providers. Vinsdaddy does not own or control these data sources and cannot guarantee their accuracy, completeness, or timeliness.

Vehicle history information may be delayed, incomplete, or unavailable for certain vehicles. A Report should be used as one of several tools in your vehicle research process, alongside a professional pre-purchase inspection and verification of title with the relevant authorities.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to personal jurisdiction in such courts.

14. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site, you agree to first contact us at support@vinsdaddy.com to attempt to resolve the dispute informally. We will make good-faith efforts to resolve any issue within 30 days.

If informal resolution fails, you agree that any unresolved dispute shall be settled by binding arbitration administered under the rules of the American Arbitration Association (AAA), on an individual basis. You waive any right to participate in class action litigation or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent or enjoin infringement of intellectual property rights.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page. Your continued use of the Site after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
